Terms of sale

This English version is provided for convenience. In case of discrepancy, the French version prevails.

Article 1 — Purpose and scope

These General Terms and Conditions of Sale (the "Terms") govern sales of products concluded on the prestige99.com website between PRESTIGE (Imran Merceron, sole trader, hereinafter "the Seller") and any non-trading natural person making a purchase (hereinafter "the Customer" or "the Consumer"). Placing an order implies unreserved acceptance of these Terms, which the Customer acknowledges having read before confirming the order.

Article 2 — Products

The products offered are those shown on the website on the day it is viewed, while stocks last. Photographs and descriptions are as accurate as possible but cannot guarantee a perfect match with the product delivered, in particular due to display settings. Some items (notably the jerseys) have a deliberately oversized fit, as specified on the product page.

Article 3 — Prices

Prices are shown in euros, excluding shipping costs. PRESTIGE benefits from the VAT exemption scheme for small businesses (article 293 B of the French General Tax Code): no VAT is charged on prices. Shipping costs are shown before the order is confirmed. The Seller reserves the right to change its prices at any time, it being understood that the product will be invoiced at the price in force when the order is confirmed.

For promotional offers, the crossed-out reference price is the lowest price applied during the 30 days preceding the discount, in accordance with applicable regulations.

Article 4 — Orders

The Customer selects products, adds them to the cart, then confirms the order after checking its content and entering their details (a phone number is required for delivery). Confirmation of payment concludes the sale. A confirmation email summarising the order is sent to the Customer. The Seller reserves the right to cancel or refuse any order involving a payment dispute or showing unusual characteristics.

Article 5 — Payment

Payment is made online when ordering, using the methods offered on the website (bank card and other solutions shown at checkout). Transactions are secure. The order is only processed once payment has actually been received.

Article 6 — Delivery

Products are delivered to the address provided by the Customer. Indicative delivery times from shipment:

  • France: 5 to 7 working days
  • Europe: 7 to 12 working days
  • Rest of the world: 10 to 20 working days

These times are given for information only. In accordance with article L.216-1 of the French Consumer Code, failing any indication, the Seller delivers no later than 30 days after the contract is concluded. In the event of delay, the Customer may, under the conditions provided by law, require the Seller to deliver within a reasonable additional period, then terminate the contract if delivery does not take place.

The transfer of risk (loss, damage) occurs upon physical delivery of the product to the Customer. The Customer is invited to check the condition of the parcel upon receipt and to report any anomaly.

Article 7 — Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay any penalty.

To exercise this right, the Customer notifies their decision by an unambiguous statement (email to contact.prestige99@gmail.com) or by using the model withdrawal form available in the Return Policy.

The Customer returns the product without undue delay and no later than 14 days after communicating their decision. Return shipping costs are borne by the Customer. The product must be returned new, unworn, unwashed, in its original condition and packaging, with tags intact. The Customer may be held liable for any loss of value resulting from handling other than what is necessary to establish the nature and characteristics of the product.

The Seller refunds all sums paid, including the initial standard delivery costs, no later than 14 days after being informed of the withdrawal decision. The Seller may withhold the refund until the product has been received back or until the Customer has supplied proof of shipment, whichever is earlier. The refund is made using the same payment method as the one used for the order.

Article 8 — Statutory warranties

Independently of any commercial warranty, the Seller remains bound by:

  • the statutory warranty of conformity (articles L.217-3 et seq. of the French Consumer Code): the Customer has 2 years from delivery of the goods to take action; they may choose between repair or replacement of the goods, subject to the cost conditions provided by law, and benefit from a presumption that the defect existed at delivery for 24 months;
  • the warranty against hidden defects (articles 1641 et seq. of the French Civil Code), allowing the Customer, within 2 years of discovering the defect, to obtain cancellation of the sale or a price reduction.

The Consumer cannot waive these warranties, which apply free of charge. To make a claim, the Customer contacts the Seller at contact.prestige99@gmail.com.

Article 9 — Customer service and complaints

Any complaint can be sent to contact.prestige99@gmail.com. The PRESTIGE team undertakes to respond as quickly as possible.

Article 10 — Consumer mediation

After first contacting customer service in writing and failing a satisfactory response, the Customer (consumer) may, free of charge and within one year of their written complaint, refer the matter to the following consumer mediator:

CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris, France
Tel.: +33 1 89 47 00 14
Website: https://www.cm2c.net/declarer-un-litige.php
Email: litiges@cm2c.net

For cross-border disputes within the European Union, the Customer may contact the European Consumer Centre (ECC) France.

Article 11 — Personal data

The processing of personal data is described in the Privacy Policy available on the website.

Article 12 — Applicable law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the French courts have jurisdiction under ordinary law conditions.
